TERMS AND CONDITIONS

 

PARTICIPATION

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Southtrade International Pty Ltd (ABN: 46 099 947 163) of Level 4, 15 Blue Street North Sydney 2060  (ph: +61 2 8080 9150)  (“Promoter”).
  3. Entry is only open to individuals who are: (a) at least eighteen (18) years of age; and (b) employed as a bartender at an on-premise licensed venue in Australia (each an “Eligible Entrant”). For clarity, the Promoter will decide in its sole discretion whether an individual will meet the above criteria.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. The promotion commences on 10/03/25 and ends 11:59pm AEDT on 30/04/25 (“Promotional Period”).
  6. There are two (2) components to this promotion: (1) an online social media entry component (“Online Entry”); and (2) a cocktail making component (“Cocktail Making”).

ONLINE ENTRY

  1. To participate In this promotion, Eligible Entrants must, during the Promotional Period, complete the following steps:
    • Post on your social media page (have your page set to public)
    • Upload a high-resolution images of the cocktail and include a Marie Brizard bottle in at least one image
    • In the caption briefly provide answers to the following questions:
      • What is the name of your cocktail creation?
      • What are your cocktail ingredients (please note: all ingredients must be safe for consumption. For clarity, ingredients such as dry ice can be dangerous when used incorrectly).
      • What is the garnish for your drink?
      • Tell us how to make your drink step by step, including any homemade ingredients. All measurements must be in millilitres (with “dashes” and/or “drops” being the smallest acceptable quantities);
      • In 75 words or less, please tell us about your cocktail creation and tell us about how that led you to create your cocktail;
      • What glass is your cocktail served in?; and
      • What kind of ice do you need to make and serve your drink?

  1. The cocktail creation must include any Marie Brizard liqueur. The cocktail must not contain any other liqueur brands. The cocktail must contain a minimum of 30ml Marie Brizard with no more than six (6) ingredients. The cocktail must be no more than 1.8 standard drinks in strength.
  2. Any garnish or spritz that is not already listed as an ingredient and which changes the taste or aromatic profile of the cocktail will be considered an additional ingredient, for example: aromatic herbs, zests, spices or bitters applied to the glass or drink. The cocktail recipe should contain commonly available ingredients. Commonly available ingredients are those ingredients that are frequently available to ‘cocktail bars’ around the world. For clarity, house specific, or home-made ingredients will not be acceptable unless these ingredients are easy to make and are accompanied by a full recipe and methodology of preparation. However, home-made syrups and shrubs are permitted, as are home-made bitters and tinctures. Home-made fermented beverages (such as kefir, kombucha and kvass) are permitted.
  3. Illegal ingredients (such as any illicit drug or psychotropic) are strictly prohibited and cocktails cannot contain tobacco.
  4. Cocktail names must be original and cannot contain any third party’s copyright or trademark or any retailer’s name (however, cocktail names may use the Marie Brizard brand in the name). Cocktail names must also adhere to the Southtrade Australia Responsible Marketing Principles. In particular cocktail names cannot:
    • appeal to those below the legal drinking age;
    • emphasise or allude to the alcoholic strength or the alcohol effect of the drink;
    • suggest association with illicit drugs or the effects of illicit drugs;
    • associate with bravado, dangerous or anti-social behaviour;
    • associate with sex or sexual success;
    • association with sports, educational activities or civic/ religious festivities;
    • imply any medicinal properties or values;
    • contain any cultural appropriation (including, but not limited to, the exploitation or adoption of another culture’s traditions and/or identity);
    • link to illegal, irresponsible or immoderate consumption; and/or
    • allude to enhanced mental or physical capabilities.
  1. Only one (1) entry is permitted per Eligible Entrant.
  2. The judging for the Online Entry component will take place at Southtrade International Pty Ltd, Level 4, 15 Blue Street North Sydney 2060 on 7/05/25. The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. Winners will be notified by telephone and via email.
  3. From the pool of the valid entries, the judges will select ten (10) entries per region

Region Group 1 – QLD, NSW and ACT

Region Group 2 – VIC

Region Group 3 – TAS, SA and NT

Region Group 4 – WA

which the judges will deem to be, in their sole discretion, the winning shortlisted entries for the Online Entry component.

  1. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creative merit, originality and the cocktail’s name. The Promoter’s decision is final and no correspondence will be entered into.
  2. The winning shortlisted Eligible Entrants of the Online Entry component will automatically be granted entry into the Cocktail Making component (as outlined below).
  3. Eligible Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Eligible Entrants warrant and agree that:
    • they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    • their Content shall not contain viruses or cause injury or harm to any person or entity;
    • Their Content shall not damage the Promoter’s brand or bring the Promoter into disrepute;
    • they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    • they will obtain full prior consent from any person who has jointly created or has any rights in the Content to the uses contemplated by these Terms and Conditions, and the Content does not infringe the rights of any third party;
    • they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    • they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, Eligible Entrants agree to indemnify the Promoter for any breach of the above terms.

  1. As a condition of entering this promotion, each Eligible Entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

COCKTAIL MAKING

  1. Between 8/05/25 and 16/05/25, the Promoter will organise with Eligible Entrants who are entered into the Cocktail Making component to sample their cocktail creation, as outlined in their Entry. For clarity, the Promoter will ultimately determine the exact time and date when the Eligible Entrant will be required to make their cocktail to be sampled in their place of work. When asked to do so, the Eligible Entrant must make and serve the cocktail that was submitted in their Entry to the judges. For clarity, the cocktail must be exactly as per what was outlined in their Entry. The Promoter reserves the right, in their sole discretion, to disqualify any Eligible Entrant that changes or modifies their cocktail. If excessive travel is required to judge Eligible Entrants alternate options may be explored. Shortlisted drinks must be menu listed in the Entrant’s home bar for the Judging period.
  2. The Promoter will individually judge all cocktail creations and will, in their sole discretion, pronounce a minimum of four (4) Eligible Entrants as the Cocktail Making finalists – one per region (each a “Finalist”).
  3. Finalists can share a photo of their drink on social media and must tag the Promoter. For clarity photos of drinks must not include any individuals.
  4. The Finalists will be required to make their cocktail creation in front of a panel of judges, as determined by the Promoter in their sole discretion. The judging for the Finalists will take place at 11:00am AEST on 17/06/23 at La La Land upstairs at The Prince Consort, 230 Wickham Street, Fortitude Valley QLD 4006 . The Promoter will provide Finalists with 1 x return economy airfares from their nearest capital city to Brisbane, QLD (only if Finalist resides outside of QLD) and return airport to hotel transfers (if needed). In the event a Finalist resides in QLD, then the Promoter will not provide that Finalist with airfares and this component is not redeemable for cash. The Promoter will also provide one (1) night of accommodation at Crystalbrook Vincent – 5 Boundary Street, Brisbane City QLD 4000. The Promoter will provide each Finalist with AUD $1000 as part of their finalist package.
  5. This is a game of skill and chance plays no part in determining the Winner. Each Finalist’s drink will be individually judged based on creative merit, taste, presentation and social media presence (including photos that Finalists have shared of their cocktail). The Promoter’s decision is final and no correspondence will be entered into.
  6. Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Finalist must travel on the dates specified by the Promoter.
  7. Finalists must depart from and return to the same departure point. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not be included in travel and travel is subject to the standard terms and conditions of individual service providers. Finalists may be required to present their credit card at time of accommodation check in. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify travel plans, subject to any written directions from a relevant regulatory authority.
  8. The total prize pool of the Cocktail Making component is valued at up to $8,000 depending on Finalist’s point of departure.

PRIZE

  1. The Finalist with the best cocktail (as awarded by the judges) will win the Prize (defined below) (“Winner”).

  1. Spending money, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the group trip and is subject to booking and flight availability. Travel is only valid before 01/07/25 subject to any exclusions and/or block out periods. Finalists may be required to present their credit card at time of accommodation check in.
  2. Finalists are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and other travel documentation (including, without limitation, proof of COVID-19 vaccination in an appropriate form, if required) at their own cost. Finalists must depart from and return to the same departure point. Prize is non-transferable, non-assignable, non-exchangeable and non-redeemable for cash, unless otherwise advised.
  3. The total prize pool for this promotion is valued at up to $15,000.

GENERAL

  1. The Promoter reserves the right, at any time, to verify Eligible Entrants’ identity (including name, age and place of work) and reserves the right, in its sole discretion, to disqualify any Eligible Entrant that the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  2. The Promoter’s decision is final and no correspondence will be entered into.
  3. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of that prize) will be forfeited and will not be redeemable for cash.
  4. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.
  5. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at nhmrc.gov.au.
  1. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification.
  1. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

 

  1. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event the Eligible Entrant is declared a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  2. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  3. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the winner’s sole responsibility. Winners should seek independent financial advice in this regard.
  4. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  5. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if a distillery tour is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by an Eligible Entrant or winner; or (g) use of or participation in a prize.
  6. As a condition of accepting the Prize, the Prize Taker must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  7. The Promoter collects information about Eligible Entrants in order to conduct the promotion. Such individuals consent that any or all of the information submitted may be held and used by the Promoter and other companies within the Promoter’s group of companies or the Promoter’s agents, partners or licensees, to contact the Eligible Entrant in relation to the promotion and to further promote, to consider ways of improving, and to send information about the Promoter’s products and services by email and as otherwise set out in the Promoter’s privacy policy, which is available at https://southtradeint.com.au/privacy-policy/. Information collected, will be handled in accordance with the Promoter’s privacy policy which contains information about how to access and correct information that the Promoter holds about the individual, and how complaints can be made and will be resolved.  If an Eligible Entrant does not provide all of the requested information they may be ineligible for the promotion and/or the Promoter may be unable to contact them with additional offers.  Information collected may be transferred to France and may be shared with third-party service providers who process the information in France or Australia solely to enable the provision of services to the Promoter. Information collected may be transferred to another company or entity in the event that any part of the Promoter’s business is transferred to, sold to or merged with a company or entity or if the Promoter is required to do so by law, regulation or at the request of a public authority. If in the future, an individual does not wish to receive further communications from the Promoter and would prefer to be removed from its databases, if they simply wish to make corrections to their information on record or if they have a complaint (which we will endeavour to resolve within a reasonable time), please inform us in writing. All entries become the property of the Promoter.
